What Is Right To Repair?

In accordance with the Housing (Scotland) Act 2001, the Scottish Secure Tenants (Right To Repair) Regulations 2002 came into force on 30th September 2002.

The scheme requires the Association to maintain a list of alternative contractors to be available to back up the existing service.

Where appointed contractors fail to carry out certain “qualifying repairs” within the stipulated timescale identified in the legislation, you are able to contact the alternative contractor to carry out the work within the same time period, and be entitled to compensation.

 

When Can I Use The Right To Repair?

The Right to Repair period starts on the first working day after,

Either,

The date the Association receive the qualifying repair request from the tenant.

Or

Where the Association requires to inspect the property, the date of inspection.

 

Example

A blocked toilet is reported to CVHA Tuesday at 11.00 am. CVHA issue the order, to be complete within 24 hrs, the work to be completed that day or the Wednesday morning. If the contractor does not appear to make a start by 9.00 am on the Thursday the tenant is entitled to contact the secondary contractor.

Where tenants wrongly call out a contractor or misuse the services, the repair will become rechargeable. This will be made clear when the repair is reported.
